Return of Tribunal Fees?


Since employment tribunal fees were abolished in July 2017 there has been a spike in the number of claims brought in the tribunal. The total caseload outstanding for employment tribunals at the end of June 2018 increased by 77% compared to the same period the previous year (which does not include class action claims).

The Ministry of Justice is now looking at how employment tribunal fees might be reintroduced according to comments made by Richard Heaton, a Permanent Secretary at the Ministry of Justice, when he gave evidence before the House of Commons Justice Commons on 2 November 2018.

However, relief for employers may be some way off since there is no finalised proposal on how or when to implement a revised scheme and it does not feature in the government's current legislative programme.
